Four Things To Do After A Workplace Accident

If you were injured while at work, you may be wondering what you should do now. Should you tell your employer? Should you just let it go? Should you talk to a lawyer or a third party first?

Whether you were injured in a farming or forklift accident, knowing what to do next is important. Taking the wrong steps can limit or even eliminate your options for seeking compensation. At Gamez Law Firm, we strive to help our neighbors in San Antonio be as prepared as possible after workplace accidents.

1. Tell your employer. The sooner you can tell your employer, the better. In Texas, you must report an injury to your employer within 30 days. If you do not, you may lose your right to seek workers’ compensation benefits.

2. See a doctor. It is important to seek medical attention soon as you can after an accident. Seeing a doctor will help you establish a strong record of visits related to your appointment and ensure that your injuries are well-documented. This will be helpful if you choose to file a claim against a third party.

3. Complete a claim. If you are seeking workers’ compensation, you must complete DWC Form-041 and send it to the Texas Department of Insurance within a year of your accident. If you do not, you risk not being able to seek workers’ compensation benefits.

4. Talk to an attorney. When you are dealing with a workplace injury, it is wise to have a strong advocate on your side. Insurance companies — whether it is your employer’s or a third party’s or both — don’t have your best interests at heart. We do. We will fight to protect your rights, and vigorously pursue fair compensation on your behalf.
