Most Texas drivers are aware of the dangers of driving over railroad tracks and use caution when a railroad crossing is necessary. Trains travel at very high speeds and they cannot stop quickly, even when there is something blocking their path. On rare occasions, a vehicle may become disabled on a train track, making a collision unavoidable. This happened recently in Odessa after a deadly crash occurred near the tracks.
Unusual circumstances after a fatal accident
The two-vehicle collision happened on a Wednesday morning. A pickup truck pulling a trailer collided with a minivan near West Murphy and Business 20. The driver of the minivan was killed in the accident. A passenger in the van was taken to a nearby hospital with critical injuries.
The collision caused the pickup truck to roll onto the nearby train tracks. The pickup driver was able to get out of the truck before the collision with the train. Authorities will continue to investigate this accident to see who was at fault. It’s possible that charges could be filed against the pickup driver if the evidence indicates negligence was a factor in the crash.
Filing a wrongful death lawsuit
Losing a loved one in a motor vehicle accident is a very difficult thing for a family to process, especially if the accident was caused by a negligent driver. Families are often in shock initially, but when the shock wears off, they may find themselves in a financial burden with all the expenses that can come from such an accident. Texas families who have lost a loved one due to driver negligence have the right to pursue compensation through a wrongful death lawsuit to help cover those expenses.
